Do I Need an Attorney to Buy a Home in NC?

Short answer: yes. North Carolina is what’s known as an attorney state: real estate closings here are conducted by licensed attorneys, not title companies or escrow officers as in many other states. If you’re relocating from elsewhere, this is one of the first process differences you’ll notice.

What your closing attorney actually does

Between contract and closing, your attorney:

• Searches the title: confirming the seller actually owns what they’re selling, and surfacing liens, judgments, or claims against the property
• Arranges title insurance: protecting you (and your lender) against title defects that surface later
• Prepares and reviews closing documents: the deed, settlement statement, and the stack you’ll sign
• Conducts the closing itself: disbursing funds, recording the deed, and making the house legally yours

What your agent can (and can’t) do

Here’s a nuance that surprises people: real estate agents in North Carolina cannot draft contract language. We work from standard forms approved by the NC Bar Association and NC REALTORS®, and we can fill in their blanks, but custom legal terms require an attorney. When a transaction gets creative, the attorney joins early, not just at the end.

Choosing one

Closing attorneys are not interchangeable. Responsiveness and real estate focus vary widely, and a slow attorney can genuinely jeopardize your closing date.
